This report investigates what is being named the biggest disaster in Brazil's mining history. A horror mudslide swept through the towns and villages in the Gualaxo River Valley, destroying homes, businesses and taking the lives of 19 people. A tailings dam, holding back more than 50 million cubic metres of mining waste collapsed, unleashing a wave of mud several metres high. "The mud dragged me down, I would come up, it would take me down again... I screamed but nobody answered", remembers Priscila Barros, who was pulled four kilometers under the deadly slurry. The mud, containing lead, arsenic and other toxic chemicals, continued down river all the way to the Atlantic coast 600km away. "This mud wave has killed anything that was alive in these water systems", explains Marilene Ramos of the Brazilian Environment Authority. Now Brazilian police are seeking the arrest of 12 of Samarco's executives for negligent homicide and crimes against the environment. "A dam doesn't break by chance. There is repeated, continual negligence in the actions of a company owned by Vale and BHP", says prosecutor Carlos Eduardo Pinto. Brazil dam disaster: BHP Billiton faces lawsuit in Australia

Mining giant BHP Billiton says it will defend itself against a class action lawsuit in Australia over Brazil's 2015 dam disaster. The collapse of a dam at a Samarco mine killed 19 people and led to Brazil's largest environmental disaster. The Samarco mine is jointly owned by BHP and Brazil's Vale.More than 3,000 investors have signed up to the lawsuit, lodged in the Federal Court of Australia in May. The claim alleges that BHP failed to disclose the risk of the dam's failure to the stock market, and misled investors over the company's safety guarantees. The action from Australian law firm Phi Finney McDonald will seek to recover shareholder losses. The claim estimates more than A$25bn (£14bn; $18bn) was wiped off BHP's market value in the month following the November 2015 tragedy. The Anglo-Australian miner's stock prices fell by 22% on the Australian Securities Exchange, and by 23% on the London Stock Exchange and Johannesburg Stock Exchange. "Given the share price fall and the high volumes of shares traded, we believe it a very significant claim," principal lawyer Brett Spiegel told the BBC. BHP is also facing a US shareholder class action over the disaster, as well as ongoing criminal and civil cases in Brazil. Last month, the company reached a deal with Brazilian authorities to push back a $47. 5bn civil lawsuit for two years while both sides negotiate a settlement.The collapse of the dam, which had carried contained waste from the nearby iron ore mine, caused a deadly mudslide which flattened several small communities and polluted a river.

In November 5, 2015, two tailings dams (Fundão and Santarém) burst at an iron ore mine operated by Samarco Mineração SA, a joint venture between Vale SA (50%) and BHP Billiton Brasil Ltda (50%), in Mariana, state of Minas Gerais, Brazil. It killed 20 people, 1703 affected fisherman, 941 families made homeless, 1 million and 500,000 people affected, the entire Doce River basin destroyed, 65 million m3 of toxic mud. Brazilian Federal Police Investigation Report confirms that it was a criminal disaster. The main factors that contributed to the disruption were drainage problems, the use of low-quality material for the dam construction, insufficient monitoring and lack of control of the amount of waste dumped in the reservoir.

U.S. equities shrugged off a mammoth new jobs number, clinging instead to the rate ramifications of the swaggering data. The report showed that new positions created in December numbered 292,000, a data point that will sure be revised upward (as were the numbers for October and November). That means that in Q4 of 2015, jobs will have been added at a rate of 3.4 million per year. Can the U.S. economy keep the pace up? Probably not, but the cooling down will take some time. It also means that the Federal Reserve through the Federal Open Market Committee most likely will remain on track to raise rates again as it strives to return to monetary normalcy. Although the Fed needs to continue to closely watch labor utilization, which is finally beginning to improve and wage inflation, which stubbornly is staying subdued and sometimes falls back a peg or two. (s it did this month. Equities traders are still nervous about China’s woes, although it is really the multinationals that are mostly being affected and that reflects quite strongly in stock prices. That doesn’t mean America’s economy is sick or faltering, but rather that more than any other country’s markets, those in the U.S. (New York) act like the world economy’s thermometer. China has real problems, as do Brazil, Russia, parts of Southeast Asia/Oceania, Africa and some other countries in South America. Europe is slow but doing decently. Canada, Australia and Japan have their woes but are not hurting, although the two former British colonies have issues with their commodities’ sector. Japan still needs to go wild with easier credit to encourage domestic consumption. Another focus of investors today in New York was the continuing swan dive of oil into an abyss of low pricing. At 3:30 in New York, both West Texas Intermediate and Brent North Sea were trading below $34 per barrel. WTI settled down 10% on the week and is searching for a bottom the way you do when coming down a ladder in a dream, foot out tapping, seeking solid ground. Gold lost about $6 (again at 3:30 in NY) as profit-takers dropped by to pick up their winnings for the week. A stronger dollar didn’t help gold, but most of the downward momentum was provided in “real” trading on the floor. Silver was hurt quite a bit more than gold, down 37 cents per ounce or 2.50%. Aside from blaming it on profit taking, the price drop in the precious metals is anomalous because certainly a safe haven is called for at least for the short term while China gets its self together and the rest of the world processes he meaning of China’s participation in the world economy. Despite the admissions of guilt, denials came from each of the defendants on key points in the trial. Paintings were displayed outdoors publicly throughout Edmonton and their stories shared on YouTube. I used art from the beginning to defend freedom of expression on the Alberta Legislature grounds when it was verbally banned 3 times by Legislature officials. Some of the YouTubes published shared how the wildfires and flooding that followed affected Albertans, their communities and the environment. I hope my art and the stories shared will inspire us to contemplate the calamities in Alberta of 2016 as a collective and together help each other find ways and better solutions to save our planet and our children's future. The bank said Vale could also draw down its 30 million tonnes of ore stockpiled in China and Malaysia.Because of Vale’s woes, Goldman Sachs lifted its iron ore price forecast from $US70 to $US80 a tonne for the next three months and from $US60 to $US65 for the second half of the year.“We can expect a lot of volatility in prices, at least in the short term,” Wood Mackenzie analyst Cicero Machado said. The WA State Budget in May estimated that a $US5-a-tonne iron ore price increase would lift annual revenue by $380 million, but 88 per cent of the gain would be lost in later years because of lower GST grants.WestBusiness understands that revised GST arrangements passed in Federal Parliament in November will allow WA to keep much of the benefit. Since Tuesday, the first ASX trading since the dam failure, Fortescue Metals Group shares have risen 13 per cent. Shares in the more diversified Rio Tinto and BHP have risen 8.5 per cent and 4.7 per cent respectively, over the two days.Rio, at $87.30 a share, has reached a value not seen since the 2008 global financial crisis.The relative share price movement of the three iron ore miners matches Macquarie’s analysis that a 10 per cent ore price increase would more than double Fortescue’s earnings and boost Rio and BHP by 14 per cent and 10 per cent respectively.Since the failure of the dam at Brumadinho last week Vale shares have fallen almost 24 per cent.In November 2015 an upstream method dam in Brazil owned by the BHP and Vale joint venture Samarco burst and killed 19 people. Vale has decommissioned nine of its 19 dams of that kind since the Samarco failure.Brazilian police have arrested three Vale employees and two contractors who worked for a German consultancy firm that had recently carried out safety studies concluding the Brumadinho tailings dam was stable.Brazil monitors the safety of tailings dams by the miners paying independent consultants to inspect the dams.
